1. AGREEMENT AND SCOPE
These Terms of Service and End-User License Agreement ("Terms") are an agreement between you and Wolf Real Estate Group Inc ("ARC," "we," "us," or "our"). They govern your access to and use of ARC: Aspect Ratio & Resize for Mac, also known or distributed as Aspect Ratio Calculator; the website at https://aspectratiocalc.com; support and contact channels; related documentation; and related services.
For the Mac application distributed through the Mac App Store, these Terms include an end-user license agreement for the licensed application (the "Licensed Application"). These Terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for the Licensed Application and its content, except as expressly stated in these Terms.
By downloading, installing, accessing, purchasing, or using the Licensed Application, website, support channels, or related services, you agree to these Terms. If you do not agree, do not use them.
These Terms do not replace, limit, or conflict with the Apple Media Services Terms and Conditions, Mac App Store rules, or other Apple terms applicable to your Apple Account, purchases, refunds, Family Sharing, volume purchasing, or use of Mac App Store applications. If these Terms conflict with Apple's applicable usage rules, Apple's applicable usage rules control to the extent of the conflict.
2. WHAT ARC DOES
ARC is a native Mac utility for calculating image dimensions and aspect ratios; inspecting images; resizing images; resizing canvas or frame dimensions; previewing placement and crop behavior; copying developer-, designer-, and workflow-friendly output; sharing rendered output through macOS; and exporting image assets.
ARC's core workflow is:
Original Size -> New Size -> Preview -> Copy / Export
ARC is a precision sizing and image-output utility. It is not a full image editor and is not a substitute for professional design, photo editing, retouching, illustration, layout, legal, regulatory, accessibility, publishing, advertising, printing, or other professional review. You are responsible for verifying calculations, dimensions, output, and suitability for your intended use before relying on them.
3. ELIGIBILITY AND LEGAL COMPLIANCE
You may use ARC only if you can legally enter into these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and accept these Terms on your behalf. If you use ARC for an organization, you represent that you have authority to bind that organization to these Terms.
You represent and warrant that:
(a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and
(b) you are not listed on any U.S. Government list of prohibited or restricted parties.
You are responsible for complying with all laws, rules, regulations, sanctions, export controls, and applicable third-party terms relating to your use of ARC, your images and files, exported or shared output, purchases, and downstream uses.
4. LICENSE; LICENSED, NOT SOLD; RESERVATION OF RIGHTS
The Licensed Application is licensed, not sold.
Subject to these Terms and Apple's applicable terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application for personal or business purposes on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Where Apple's rules and the applicable product configuration allow it, the Licensed Application may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
Unless an update is accompanied by separate terms, these Terms also govern updates, upgrades, bug fixes, patches, and replacement or supplemental components that we provide for the Licensed Application.
We and our licensors reserve all rights not expressly granted to you under these Terms. No rights are granted by implication, estoppel, or otherwise.
5. RESTRICTIONS
Except where applicable law expressly permits otherwise, you may not:
(a) copy, modify, adapt, translate, reverse engineer, decompile, disassemble, derive source code from, or create derivative works of the Licensed Application;
(b) rent, lease, lend, sublicense, sell, redistribute, publish, transfer, or commercially exploit the Licensed Application except as Apple's applicable terms expressly allow;
(c) bypass, disable, defeat, tamper with, or interfere with purchase validation, entitlements, feature gates, usage limits, access controls, security, or technical protections;
(d) use ARC for unlawful, abusive, fraudulent, infringing, misleading, harmful, or malicious purposes;
(e) introduce malware, probe or disrupt security, overload systems, scrape restricted areas, or interfere with the operation or availability of the Licensed Application, website, support channels, or related services;
(f) remove or obscure copyright, trademark, attribution, or proprietary notices; or
(g) use ARC in violation of these Terms, Apple's applicable terms, third-party terms, or applicable law.
6. YOUR IMAGES, FILES, AND OTHER CONTENT
You retain ownership of images, files, dimensions, templates, messages, and other content that you use with or submit through ARC ("Your Content").
You are responsible for ensuring that you have all rights, permissions, and lawful bases needed to process, resize, crop, export, share, upload, submit, or otherwise use Your Content. ARC does not give you ownership of third-party images, fonts, designs, trademarks, logos, screenshots, templates, copyrighted works, or other materials.
When you voluntarily submit Your Content through a support or contact channel, you grant us a limited, non-exclusive, worldwide, royalty-free license to receive, store, reproduce, and use that content only as reasonably necessary to provide support, investigate issues, operate and secure the services, improve ARC, enforce these Terms, and comply with law. This limited license does not transfer ownership of Your Content.
You are responsible for reviewing exported files, shared output, image dimensions, quality settings, format choices, metadata, compression, color behavior, filenames, and downstream use before relying on them. You should keep appropriate backups of important source files and output.
7. LOCAL PROCESSING, PRIVACY, OPTIONAL EMAILS, AND ANALYTICS
ARC is designed to be local-first. Images you select, drag in, paste, inspect, resize, place, export, copy, or share are intended to be processed on your Mac. The Licensed Application does not upload your image files to us merely because you use its core image-processing features.
Certain features may use Apple-controlled systems or third-party infrastructure, including App Store purchase and entitlement validation, iCloud settings sync, macOS sharing destinations, website security, support communications, optional email updates, and optional product analytics.
Optional email updates, optional product analytics, and optional personalization choices are governed by the settings and consent choices presented to you and by our Privacy Policy. They are not required to use the core app or paid features unless a particular feature clearly states otherwise.
Our Privacy Policy, available at https://aspectratiocalc.com/privacy, explains what information we process, how we use it, service providers involved, retention, and your choices and rights. The Privacy Policy is incorporated into these Terms by reference. If these Terms conflict with the Privacy Policy concerning the collection, use, retention, or disclosure of personal information, the Privacy Policy controls.
8. COMPATIBILITY, OUTPUT, AVAILABILITY, AND CHANGES TO FEATURES
ARC supports the macOS versions identified in the applicable Mac App Store listing and product materials. Features may depend on your Mac, macOS version, Apple frameworks, system encoders, permissions, file type, image characteristics, storage, iCloud availability, network access, and App Store entitlement status.
For example, HEIC export may be available while HEIF availability may depend on the macOS encoder. Native sharing depends on macOS share-sheet behavior and the destinations available on your Mac.
We do not guarantee that exported or shared output will be accepted by every website, marketplace, social network, printer, MLS system, advertising platform, app store, content management system, publication, accessibility checker, or other third-party service. Those services may impose their own file, dimension, color, compression, metadata, content, legal, and upload requirements.
We may add, improve, modify, suspend, or remove features, integrations, free allowances, or support for particular formats or operating systems as ARC evolves. We will not convert a valid Mac Lifetime entitlement into a recurring subscription. Any material reduction of an already-purchased entitlement remains subject to applicable law and the transaction-specific terms shown at purchase.
9. FREE FEATURES AND PAID FEATURES
ARC may be free to download with a useful core feature set. Free features may include basic aspect-ratio calculations, image inspection, built-in copy outputs, output-size copying, previews, and limited exports.
Free use may include a limited number of image exports or other usage allowances during a stated period. ARC may use local storage, iCloud key-value storage, or another app-controlled counter to track an allowance and reset period. We may change free features or allowances prospectively.
Paid features may include saved custom ratios, custom copy templates, advanced unit conversions, configurable metadata chips, iCloud settings sync, premium themes, exact-size preset or ratio packs, advanced resize and canvas tools, batch workflows, enhanced export tools, and other premium features.
A paid product grants only the entitlement, features, platform coverage, term, and Family Sharing status shown on Apple's purchase screen and in the applicable product description. A separately sold feature pack does not unlock all Pro features unless the purchase screen expressly says that it does.
10. PURCHASES, SUBSCRIPTIONS, TRIALS, MAC LIFETIME, FAMILY SHARING, LEGACY ENTITLEMENTS, AND SUPPORT PURCHASES
Purchases are offered and processed through Apple's Mac App Store and StoreKit. Available products may vary by storefront, account, device, app version, eligibility, and time.
10.1 Subscriptions and Trials
A monthly or annual subscription provides Pro access for the subscription period shown by Apple. Subscriptions automatically renew until canceled. Apple charges the payment method associated with your Apple Account under Apple's billing rules.
You may cancel through the subscription-management controls provided by Apple. Deleting ARC does not cancel a subscription. Unless Apple or applicable law provides otherwise, cancellation takes effect at the end of the then-current paid period, and access continues until that period ends.
A free or discounted trial may convert to a paid, automatically renewing subscription unless canceled before the trial ends. The trial length, price, billing period, renewal terms, eligibility, and cancellation deadline shown by Apple at confirmation control.
10.2 Mac Lifetime
"Mac Lifetime" means a non-expiring entitlement to the applicable paid features in the Mac version of ARC distributed under the same Mac App Store app record and associated with the Apple Account used for the purchase.
Mac Lifetime does not mean the purchaser's lifetime and does not guarantee perpetual maintenance, support, Mac App Store availability, compatibility with future hardware or macOS versions, or access to separately distributed successor applications, separate add-ons, or applications for other platforms unless the purchase screen expressly includes them.
We will not convert a valid Mac Lifetime entitlement into a recurring subscription. Re-downloads, restorations, receipt availability, and continued distribution remain subject to Apple's systems and terms.
10.3 Family Sharing
Family Sharing applies only where Apple and the specific product configuration permit it. A product that is not configured for Family Sharing does not become family-shareable merely because another ARC product is. Family access may depend on the purchaser's and family members' Apple Account settings, region, and Apple's Family Sharing rules.
10.4 Legacy Paid-App and Compatibility Entitlements
Customers who purchased an earlier paid version of the Mac application may receive or retain the legacy entitlement described in ARC's product materials when Apple-verifiable purchase evidence is available.
Older products, including Individual Pro, Family Pro, Family Add-On, Workspace Theme & Ratio Pack, Pro Ultimate, Pro Ultimate Family, or similarly named compatibility products, may continue to be recognized according to their original scope and valid StoreKit receipts. A legacy entitlement does not automatically include a separately sold future platform, successor application, or add-on unless we expressly state otherwise.
10.5 Support Development and Similar Purchases
Support Development, tips, donations, coffee purchases, or similarly described consumable support purchases are optional thank-you purchases. They do not unlock Pro, create a Mac Lifetime entitlement, extend a subscription, or gate app features unless Apple's purchase screen expressly states otherwise. Do not buy a support purchase expecting it to unlock paid features.
11. PRICES, BILLING, CANCELLATION, RESTORATION, TAXES, REFUNDS, AND ENTITLEMENT CHANGES
Apple controls transaction processing, prices displayed in your storefront, billing periods, payment methods, taxes, exchange-rate treatment, subscription management, purchase records, and refunds for Mac App Store transactions.
The price, billing period, trial, introductory offer, renewal terms, Family Sharing status, and other transaction-specific information shown by Apple when you confirm a purchase control over inconsistent general descriptions in these Terms, on the website, or in marketing materials.
You may use ARC's Restore Purchases function or Apple's available controls to restore eligible non-consumable purchases and subscriptions. Restoration depends on Apple's records, your Apple Account, storefront, product configuration, and network availability.
Refund requests generally must be submitted to Apple unless Apple directs otherwise or applicable law requires another process. If Apple refunds, revokes, reverses, cancels, or invalidates a transaction, the associated entitlement may be removed, adjusted, or cease to renew.
We do not receive your full payment-card number or Apple Account password.
12. MAINTENANCE AND SUPPORT
We are solely responsible for providing maintenance and support services for the Licensed Application as specified in these Terms or as required by applicable law.
You and we acknowledge that Apple has no obligation whatsoever to furnish maintenance or support services for the Licensed Application.
Support is available through the website's support or contact options and at support@aspectratiocalc.com. Support availability, response times, languages, and methods may vary. Do not send sensitive, confidential, regulated, or irreplaceable files through ordinary email or contact forms unless we expressly provide a suitable secure method.
13. ICLOUD AND APPLE-CONTROLLED FEATURES
If an eligible feature is enabled, selected settings may sync through Apple's iCloud infrastructure using your Apple Account. Synced settings may include presentation mode, custom ratios, copy formats, unit preferences, metadata-chip choices, canvas behavior, and export preferences.
We do not operate iCloud. iCloud availability and behavior are controlled by Apple and may depend on device settings, account status, storage, network access, Apple system status, and Apple's terms.
To the maximum extent permitted by law, we are not responsible for iCloud outages, Apple Account issues, sync delays, conflicts, device limits, data loss caused by Apple-controlled systems, or settings that fail to sync because of conditions outside our reasonable control.
14. WEBSITE, CONTACT FORMS, AND SUPPORT COMMUNICATIONS
The website may provide product information, App Store links, documentation, support materials, release information, images, and contact forms.
You may not submit spam, malware, unlawful or infringing material, deceptive information, threats, harassment, or confidential information that you do not want transmitted through ordinary web or email systems.
We may use hosting, security, anti-abuse, storage, analytics, customer-support, and email-delivery providers to operate the website and communications, as described in our Privacy Policy.
We may retain and use support and contact records as reasonably necessary to respond, troubleshoot, maintain security, improve ARC, preserve business records, resolve disputes, and comply with law.
15. FEEDBACK
If you voluntarily provide feedback, suggestions, feature requests, bug reports, concepts, or ideas about ARC, you grant us a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free right to use, reproduce, modify, distribute, commercialize, and otherwise exploit that feedback without restriction or compensation to you.
Do not include confidential information in feedback. This section does not transfer ownership of Your Content merely because Your Content is included in a support request; it applies to ideas and feedback about ARC.
16. INTELLECTUAL PROPERTY; THIRD-PARTY IP CLAIMS; OPEN-SOURCE SOFTWARE
ARC, the Licensed Application, website, application names, logos, interface elements, source and object code, product copy, documentation, graphics, and related materials are owned by us or our licensors and are protected by intellectual-property laws.
Apple, macOS, Mac App Store, StoreKit, iCloud, and related names and marks belong to Apple Inc. Other names and marks belong to their respective owners.
You and we acknowledge that, if a third party claims that the Licensed Application or your possession and use of it infringes that party's intellectual-property rights, we, not Apple, will be solely responsible for investigating, defending, settling, and discharging that claim, subject to these Terms and applicable law.
The Licensed Application may include open-source or third-party software governed by separate license notices. Those licenses may grant additional rights. If an applicable open-source license conflicts with these Terms, the open-source license controls solely for the relevant component and solely to the extent of the conflict.
17. THIRD-PARTY SERVICES, LINKS, AND TERMS
ARC may rely on, integrate with, or link to third-party services, including Apple, iCloud, the Mac App Store, StoreKit, macOS sharing destinations, hosting and security providers, email providers, and destinations to which you export or share content.
We do not control and are not responsible for third-party services, websites, content, terms, privacy practices, availability, security, or conduct, except to the extent applicable law provides otherwise.
You must comply with all applicable third-party terms when using ARC. This includes Apple's applicable terms; iCloud and Mac App Store terms; network-provider terms; and the terms of any application, service, website, marketplace, content management system, social network, printer, publishing platform, MLS, advertising platform, or other destination where you use, upload, export, print, publish, or share ARC output.
18. WARRANTIES AND APPLE WARRANTY REMEDY
We are solely responsible for any warranties concerning the Licensed Application, whether express or implied by law, to the extent those warranties have not been effectively disclaimed.
If the Licensed Application fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation concerning the Licensed Application.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty are our sole responsibility, subject to these Terms and applicable law.
19. PRODUCT CLAIMS
You and we acknowledge that we, not Apple, are responsible for addressing claims by you or a third party relating to the Licensed Application or your possession or use of it, including:
(a) product-liability claims;
(b) claims that the Licensed Application fails to conform to an applicable legal or regulatory requirement; and
(c) claims arising under consumer-protection, privacy, data-protection, accessibility, or similar laws.
Nothing in these Terms limits our liability beyond what applicable law permits.
20. DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARC, THE LICENSED APPLICATION, WEBSITE, SUPPORT CHANNELS, AND RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, COMPATIBILITY, SECURITY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT ARC WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH EVERY WORKFLOW, FORMAT, DEVICE, OPERATING-SYSTEM VERSION, WEBSITE, PLATFORM, PRINTER, MLS, ADVERTISING SYSTEM, APP STORE, ACCESSIBILITY STANDARD, PUBLISHING REQUIREMENT, OR BUSINESS PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS NON-WAIVABLE CONSUMER RIGHTS.
21. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS OR REVENUE; LOSS OR CORRUPTION OF DATA; BUSINESS INTERRUPTION; COSTS OF SUBSTITUTE SERVICES; LOSS OF GOODWILL; OR REJECTION, MISUSE, OR FAILURE OF EXPORTED OR SHARED FILES, ARISING OUT OF OR RELATING TO ARC OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO ARC OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID FOR THE SPECIFIC ARC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR
(b) USD $50.
The exclusions and limitations in this section do not apply to liability that cannot lawfully be excluded or limited, including liability where applicable law requires otherwise. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
22. INDEMNITY; SUSPENSION; TERMINATION; CHANGES TO THESE TERMS
22.1 Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Wolf Real Estate Group Inc and its officers, directors, employees, contractors, licensors, and agents from third-party claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising from your unlawful misuse of ARC, material breach of these Terms, violation of third-party terms, or infringement of another person's rights through Your Content or downstream use of ARC output. This obligation does not apply to the extent a claim was caused by our negligence, willful misconduct, or breach of these Terms, or where applicable law prohibits the obligation.
22.2 Suspension and Termination
You may stop using ARC at any time. We may suspend or terminate access to the website, support channels, related services, or the license granted under these Terms if you materially breach these Terms, misuse ARC, create a security or legal risk, or if suspension or termination is required by law. Where applicable law requires notice or an opportunity to cure, we will provide it.
Upon termination of the app license, you must stop using and delete the Licensed Application and any copies in your control, except where Apple's applicable terms or mandatory law provide otherwise. Apple-controlled entitlements may also change if Apple refunds, revokes, reverses, cancels, or invalidates a transaction.
22.3 Survival
Sections that by their nature should survive termination will survive, including ownership, payment and refund provisions, feedback rights, intellectual-property provisions, Apple-required provisions, disclaimers, limitations of liability, indemnity, governing law, venue, dispute-related terms, and miscellaneous provisions.
22.4 Changes to These Terms
We may update these Terms prospectively. When we do, we will update the "Last updated" date and provide additional notice or obtain consent when required by law.
Your continued use after revised Terms become effective constitutes acceptance, except where applicable law requires another form of consent. A change to these Terms will not by itself convert a valid Mac Lifetime entitlement into a subscription, retroactively shorten an already-paid subscription period, or eliminate non-waivable rights.
23. GOVERNING LAW; VENUE; JURISDICTION
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles, except to the extent applicable mandatory law provides otherwise.
Except where applicable law permits or requires a different forum, and except for an eligible individual claim brought in a small claims court of competent jurisdiction, any lawsuit, action, or proceeding arising out of or relating to these Terms, the Licensed Application, the website, support channels, purchases, or related services must be brought exclusively in the Superior Court of California, County of Riverside, or, if federal subject-matter jurisdiction exists, in the United States District Court for the Central District of California. To the maximum extent permitted by law, you and we consent to the personal jurisdiction and venue of those courts and waive objections based on improper venue or an inconvenient forum.
Either party may seek temporary, preliminary, or emergency injunctive relief in any court of competent jurisdiction when reasonably necessary to prevent actual or threatened infringement, unauthorized access, misuse, or irreparable harm.
If you are a consumer, this section does not deprive you of any non-waivable right to bring a claim in the courts of your place of residence or another forum available under applicable consumer-protection law. Consumers outside the United States may have mandatory rights under the laws of their country or region that these Terms do not limit.
24. APPLE AS THIRD-PARTY BENEFICIARY
You and we acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to the Licensed Application. Upon your acceptance of these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
25. MISCELLANEOUS
25.1 Entire Agreement and Order of Precedence
These Terms, the Privacy Policy, Apple's applicable terms, and the transaction-specific information shown by Apple at purchase form the entire agreement concerning the subjects they address and supersede prior or contemporaneous statements on those subjects.
If provisions conflict, the following order applies to the extent of the conflict:
(a) mandatory applicable law;
(b) Apple's applicable terms and purchase-confirmation information for Apple-controlled transactions, Apple services, and usage rules;
(c) the Privacy Policy for the collection, use, retention, or disclosure of personal information;
(d) these Terms; and
(e) general website or marketing descriptions.
25.2 Severability
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent, and the remaining provisions will remain effective.
25.3 No Waiver
A failure or delay in enforcing a provision is not a waiver. A waiver is effective only if in writing and signed by the party granting it.
25.4 Assignment
You may not assign or transfer these Terms or the app license except as Apple's applicable terms or mandatory law permit. We may assign these Terms to an affiliate or successor in connection with a merger, reorganization, financing, sale of assets, or transfer of the ARC business, provided the assignment does not reduce non-waivable rights.
25.5 Force Majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, utility or network failures, governmental actions, widespread cyberattacks, or failures of Apple or other essential providers. This section does not excuse payment obligations already due.
25.6 Electronic Communications and Notices
You agree that we may provide legally permitted notices electronically through the Licensed Application, website, email, or other reasonable means. Notices to us must be sent to the contact information in Section 26. Electronic notices do not replace any form of notice required by mandatory law.
25.7 No Other Third-Party Beneficiaries
Except for Apple and Apple's subsidiaries as stated in Section 24, these Terms do not create third-party-beneficiary rights.
